1. Rental Fees, Deposits & Florida Surcharge
The Renter agrees to pay the specified weekly rate in full. Per Florida Statute §212.0606, a rental car surcharge is applied to the lease of this vehicle. A security deposit and the first week’s rent are mandatory at the time of vehicle transition. Payments must be strictly maintained on a weekly basis via Zelle, Apple Pay, Venmo, Cash App, or Card. Failure to pay may result in immediate termination of this agreement.
2. Authorized Use & Geographic Limitations
Reference: Florida Statute §812.155 (Failure to return leased property)
The vehicle is to be operated solely for lawful purposes by the undersigned Renter. No other persons are authorized to operate the vehicle. Operation is strictly limited to a 60-mile radius of the designated Miami operations center; interstate travel is prohibited without prior written consent. Use of the vehicle for racing, off-roading, or any illegal activity will result in immediate repossession.
3. Maintenance, Safety & Smoking Policy
While Jackson Mobility Group LLC provides routine maintenance, the Renter is legally obligated to monitor vehicle health and report any mechanical irregularities, warning lights, or safety concerns immediately. Any damage resulting from continued operation after a fault is detected will be the Renter’s financial responsibility. This is a strictly Non-Smoking vehicle.
4. Florida Insurance Requirements for GIG Economy
Reference: Florida Statute §627.748 (Transportation Network Companies)
If the vehicle is utilized for GIG economy platforms (Uber, Lyft, DoorDash, etc.), the Renter must ensure active coverage under the platform’s commercial insurance policy. The Renter is responsible for maintaining personal injury protection (PIP) and property damage liability (PDL) as required by Florida’s no-fault insurance laws.
5. Incident Reporting & Liquidated Damages
In the event of any collision or theft, a police report must be filed, and the Owner notified immediately. The Renter is liable for a $1,000.00 deductible per incident. Damage to or loss of the vehicle key fob will incur a $200.00 replacement fee due within 48 hours. The vehicle must be returned with the original fuel level.
6. Indemnification & Liability Waiver
Pursuant to Florida law, the Renter agrees to indemnify and hold Jackson Mobility Group LLC and its managers harmless from any claims, injuries, deaths, or legal actions arising from the Renter’s possession or operation of the vehicle. The Owner is not responsible for any property left in the vehicle.
7. Governing Law & Entirety
This agreement shall be governed by and construed in accordance with the laws of the State of Florida. This constitutes the entire agreement between Jackson Mobility Group LLC and the Renter, superseding all prior verbal or written negotiations.
